Will same-sex marriage be recognized in the country? Supreme Court seeks answer from Center

Now people have started coming forward openly regarding homosexual relations. Not only this, people have also started accepting this relationship. But even though homosexuality is out of the category of crime in India, marriages done in it are not yet legally recognized. For which the Supreme Court has agreed to hear. Homosexual couples have filed a petition demanding that the Special Marriage Act be made gender neutral and same sex marriage be allowed to the LGBTQ+ community.

Supreme Court sent notice to the Center

A bench of Chief Justice DY Chandrachud and Justice Hima Kohli issued notice to the Center and asked it to file its reply on the two petitions in four weeks. The Supreme Court also took the assistance of Attorney General R Venkataramani by issuing notice to him. Same-sex couple Supriyo alias Supriya Chakraborty and Abhay Dang from Hyderabad and partner Partha Firoz Mehrotra and Uday Raj from Delhi have filed a petition in the Supreme Court seeking legal recognition of their marriage.Both the petition said It has been said that the LGBTQ community also has a fundamental right to marry anyone of their choice. The legal framework currently recognizing marriage does not allow members of the LGBTQ+ community to marry of choice.

Petitions filed in different high courts will be heard together in SC

The Supreme Court has issued a notice to the Central Government and the Attorney General regarding this and has asked them to file a reply within four weeks. Along with this, the Supreme Court has asked to transfer the pending petitions in other High Courts including Kerala here. All the cases will be heard together.

Legal recognition of marriage

One of the two petitions filed states that they are in love with each other. Together for 17 years and raising two children. But they cannot legally marry. Because of which they cannot give their name to their child. On the other hand, the second petition which has been filed by Supriyo Chakraborty and Abhay Dangar has demanded legal recognition of same sex marriage.
