The petitions against the removal of Article 370 were not heard for 3 years, the matter came before CJI Chandrachud and said – I will take a decision
Chief Justice of India DY Chandrachud said on Friday that he himself would take a decision on the listing of petitions filed against the abrogation of Article 370 from Jammu and Kashmir. The petition by senior advocate Raju Ramachandran was mentioned before a bench headed by Chief Justice DY Chandrachud. To this the CJI said, ‘I will take a decision on this…’.
Earlier in December 2022 also this matter was mentioned in front of Chief Justice Chandrachud, then Justice Chandrachud had said that we will examine the petition and fix the date of hearing. Let us tell you that at least 20 petitions are pending in the Supreme Court against the abrogation of Article 370 from Jammu and Kashmir by the Central Government.
The matter is with the constitution bench of SC
In the year 2019, the petitions filed against the removal of Article 370 from Jammu and Kashmir were referred to the constitution bench. This bench included Justice NV Ramanna, Justice Sanjay Kishan Kaul, Justice R Subhash Reddy, Justice BR Gavai and Justice Suryakant. Two of these judges, Justice NV Ramanna and Jab Justice R Subhash have also retired.
Hearing started in December 2019
A 5-judge constitution bench began hearing the matter in December 2019. At that time it was also discussed whether the matter should be referred to a 7-judge bench for reference. On 2 March 2020, the Constitutional Bench had said that there was no need to refer the matter to a larger bench.
Case not listed after March 2, 2020
After March 2, 2020, these petitions were not even listed for hearing. In September 2022, the then Chief Justice of India UU Lalit was ready for the list. Earlier in April 2022 also the matter came up before the then CJI NV Ramanna. He had not taken any decision then.
Let us tell you that in August 2019, the Central Government had abolished Article 370 from Jammu and Kashmir and also withdrew the special status given to the state through it. Ladakh was carved out of Jammu and Kashmir and made a union territory. Several applications are pending in the Supreme Court against this decision of the Modi government.
