Uttarakhand: High Court breaking MLA constructed a five storey commercial building without getting the map passed, 50 thousand fine imposed on HRDA

The Uttarakhand High Court has imposed a fine of Rs 50,000 on the Haridwar Development Authority for not submitting an affidavit on time while hearing a PIL related to the construction of a two- storey commercial building in Nazul land of the Municipal Corporation by Roorkee MLA Pradeep Batra and others. Have been asked to present the affidavit while applying.

A division bench of Chief Justice Vipin Sandhi and Justice Rakesh Patiyat stayed Batra’s second compounding application till further orders. The matter has been fixed for hearing after 4 weeks.

According to the case, Roorkee resident Mukesh Goyal has filed a PIL saying that Roorkee MLA Pradeep Batra and others have encroached on Nazul land of the Municipal Corporation and constructed a five- storey commercial building and rented it out to shops. When this complaint was made to the District Development Authority, they gave a request to get it compounded.

While getting the compound done, the authority has put a condition that you will not construct more than three storeys, you will use 50% parking in the basement and 50% for commercial purposes and make the third floor residential.

But under the guise of this, a five- storey commercial building was built by them. Along with this, shops are being made and given on rent. They again submitted an application for compounding the fourth and fifth floors. Which was again challenged in the court today.
