The Waqf Amendment Act has come into force across the country from today i.e. 8th April. Its notification has been issued by the Union Home Ministry. Before hearing the petitions challenging this Act, the Central Government has filed a caveat in the Supreme Court. In this, the court has been requested to hear the Central Government before passing any order. One of the legal documents of the Government of India is the Gazette of India. All the orders and notifications of the government are published in it.
Center issued notification regarding Waqf law
The notification issued by the Central Government said, ‘The Central Government, exercising the powers conferred by section 1 of sub-section (2) of the Waqf (Amendment) Act, 2025 (14 of 2025), hereby appoints 8th April, 2025 as the date on which the provisions of the said Act will come into force.’
Waqf law implemented, Center filed caveat in Supreme Court
The Central Government has filed a caveat in the Supreme Court. A caveat is a kind of petition. Any party can file it in the High Court or Supreme Court. Its purpose is to ensure that no order is passed without hearing it. The central government has filed this caveat against the petitions challenging the constitutional validity of the Waqf (Amendment) Act, 2025.
More than 10 petitions in SC against Waqf law
Several petitions have been filed against the new Waqf law. These include petitions from politicians, All India Muslim Personal Law Board and Jamiat Ulema-e-Hind. On April 7, a bench headed by Chief Justice Sanjiv Khanna assured Jamiat Ulema-e-Hind lawyer Kapil Sibal that they would consider listing the petitions.
President approved the new Waqf law on April 5
President Draupadi Murmu approved the Waqf (Amendment) Bill, 2025 on April 5. This bill was passed after debate in both the houses of Parliament. In Rajya Sabha, 128 members voted in favour of the Wakf Bill and 95 members voted against it. In Lok Sabha, 288 members supported it while 232 voted against it.
