Why ban on only 3 pesticides? ASG said on CJI’s question – will tell you, Chandrachud said – ‘no no no’, tell everyone

During the hearing on the petitions filed regarding the ban on pesticides, CJI DY Chandrachud reprimanded the Additional Solicitor General appearing for the government. In fact, the petition was filed regarding the banning of 116 pesticides. The CJI asked the ASG why the government banned 3 pesticides out of 27. The government lawyer replied that there is a process for everything.

The CJI immediately asked that everything in the government is a process. The government lawyer said that he would only tell the report of the committee to the bench. CJI immediately said – no no no, whatever you are going to tell us, tell the other side also. He said that the lawyer of the other side appearing in the court should also know everything.

CJI said – If the government had worked, we would not have had to do the hearing

It was demanded in the petition that there are 176 such pesticides which have been banned internationally as well. They should be banned in the country as well. These are adversely affecting the health. These are especially harmful for children. Additional Solicitor General Vikramjit said before the bench of CJI DY Chandrachud that all this cannot be allowed to go on.

The CJI asked if Vikramjit, then the public prosecutor’s answer was that ban him and not him. Such petitions need to be dismissed immediately. The CJI said that if the government had done its work properly, then we would not have needed to do it. The government needed to do its job properly.

The Additional Solicitor General said that he (Prashant Bhushan) came and said that all these things are going on. He said that Bhushan is coming and saying that ban this and not him. How can this be allowed to go on? He said that many corporates develop these pesticides and the court should not be used for this.

The CJI asked him to place the Justice Rajendran Committee’s 2022 report on record. Then be told what that report says. Then Vikramjeet said okay we are going to put him in front of the court.

CJI said – Center’s decision was not right, we will go to the bottom of it

CJI Chandrachud again said that the Center should place the Dr. SK Khurana sub committee report before the court. On September 6, 2022, Dr. TP Rajendran presided over a meeting and issued some instructions. The Center should file a separate affidavit explaining why the Center banned only a few pesticides in its February 2023 order. He said that this attitude shows that the decision of the Center was not correct. We’ll get to the bottom of it.
