Strict stance of Uttarakhand High Court, ban on order to give seniority to teachers by adding their previous service

The High Court has stayed the September 29 order of the Education Secretary to give seniority by adding the previous service of teachers adjusted to Basic. In this matter, the government has been instructed to file its reply within six weeks.

The petition of teacher Soban Singh and others was heard in a single bench of Justice Pankaj Purohit. It has been said in the petition that the department is giving seniority from the date of determination of grade 5500-9000 pay, which is against the rules. The petitioner is appointed to the post of LT Assistant Teacher.

The seniority is being decided by invalidating the earlier order passed by the division bench of the High Court. In that order it was said that the seniority of the petitioners would be calculated from the date on which they were given this pay scale. Please note that the grade pay of LT and Basic Head Master is the same.
