Now tobacco and pan masala will not be available at the same shop in UP

There is big news for the lovers of pan masala and tobacco in Uttar Pradesh. If you want to consume both pan masala and tobacco at the same shop, then you will be disappointed. According to the administrative notification, now the sale of pan masala and tobacco at the same shop has been banned. This order will come into effect from June 1, 2024 i.e. today.
Now in Uttar Pradesh, Pan Masala and Tobacco cannot be sold at the same shop. This information was given in a notification. The notification said that Regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restriction of Sales) Regulations, 2011, promulgated under the Food Safety and Standards Act, 2006, prohibits the use of tobacco and nicotine as an ingredient in any food product, in continuation of which, the manufacturing/packing, storage, distribution and sale of Pan Masala/Gutkha containing tobacco has been banned within the state of Uttar Pradesh from 01.04.2013. The said Regulation 2:3.4 proves that tobacco is a potential adulterant.
Citing the Supreme Court’s decision
The notification states that it has come to notice that various pan-masala manufacturing units are manufacturing tobacco under the brand name of pan-masala or under some other brand name and tobacco pouches are being stored and sold along with pan-masala pouches.

The Supreme Court has passed an order dated 23.09.2016 in the Transfer Case (Civil) No. 1/2010 titled as Central Arecanut Marketing Copn. & ors. Vs. Union of India to ensure full compliance of the above regulation 2.3.4. By manufacturing units manufacturing, storing, distributing and selling tobacco along with their own brand of pan-masala, the basic spirit of the above regulation and the Supreme Court’s order is not being complied with.
In the notification, it was ordered that in exercise of the powers conferred on the Commissioner, Food Safety under Section 30 (2) (a) of the Food Safety and Standards Act, 2006, in view of public health, the manufacture/packaging, storage, distribution and sale of pan masala with adulterated tobacco nicotine under the same brand name or different brand name in the same premises is hereby prohibited with effect from 01.06.2024.
