Uddhav Thackeray gets relief from SC, stays on decision of assembly speaker

The Supreme Court has given relief to the Shiv Sena camp led by Uddhav Thackeray. An application was filed in the court on his behalf, challenging the election of the new speaker of the assembly. On this application itself, the court asked the Solicitor General to tell the Speaker of the Maharashtra Legislative Assembly that he should not take any decision till the decision on this petition. Along with this, the court said that a bench will have to be formed to hear this application. In such a situation, some time is required for listing the application. There may be no hearing on this tomorrow. Even though the court has not given any decision regarding the application, but has given immediate relief to the Uddhav camp by stopping the speaker’s decision.

The court ordered Assembly Speaker Rahul Narvekar not to take any decision on the pending disqualification petitions against the Eknath Shinde faction and the Uddhav Thackeray camp for the time being. Senior advocate Kapil Sibal, appearing for the Uddhav Thackeray camp, demanded from the court that the disqualification proceedings of the MLAs be stayed. To this, Chief Justice NV Ramanna told Solicitor General Tushar Mehta, “Please tell the Speaker not to take any decision on the disqualification application until the matter is heard by the court.” Tomorrow it will not be heard, but let the speaker know about it.

During this, on behalf of the Maharashtra Assembly Secretary, it was told in the Supreme Court that according to the rules, the Speaker can take a decision on the disqualification application of the MLAs. The secretary said that now the decision on the disqualification action will be taken by the speaker Rahul Narvekar instead of the deputy speaker. Last week, Eknath Shinde proved his majority in the assembly and after that the MLAs of the Uddhav camp are in danger of losing their membership. Uddhav Thackeray had to resign from the post due to the rebellion of Eknath Shinde faction. With this, the Shiv Sena has also split and the Uddhav camp has come into trouble due to more than two-thirds of the MLAs being with Shinde.

Eknath Shinde had also attacked Uddhav Thackeray on Sunday before the hearing in the top court. He had said, ‘Some people think that they are born to rule. I am not the person who was born with a golden spoon. They should be proud that a common man is sitting on the chair. He is filing applications at night and in the morning. But even the courts know that we have the numbers and we can form the government. We have not done any illegal work.’
