Supreme Court approves constitutional amendment to BCCI
The Supreme Court on Wednesday approved the change in the cooling off period of the BCCI. After this decision, now an office-bearer will remain in the state body for more than three years and in BCCI for two consecutive terms i.e. for 6 years. Current President Sourav Ganguly and Secretary Jay Shah can get the maximum benefit from this.
Now the tenure of the State Body and the Board will not be considered together.
The Supreme Court in its decision said that now the tenure of the State Cricket Association and BCCI will not be considered together. In such a situation, after working for six years in state cricket, an officer can also work in BCCI for six years. After completion of six consecutive years in BCCI, no one can hold office for three years.
First understand what is the cooling off period?
The Lodha Committee had recommended in 2018 regarding the cooling off period. Later they were implemented from then on. According to this, if an office-bearer has previously held office in the state body for three years or more, then he can only hold office for three more years in the board. After the approval of the Supreme Court, now any office bearer can hold any position in the state for three years and for 6 years in the board.
What was the objection of BCCI?
In 2019, the BCCI had filed a petition in the Supreme Court seeking permission to do away with the three-year cooling-off period. In this case, the BCCI says that the cooling off period should come after a member holds office for six consecutive years at the same place and not the State Federation or BCCI or both.
Ganguly and Jay Shah’s tenure is coming to an end
At present, five office-bearers in BCCI including President Sourav, Jay Shah have completed 6 years in the board and state body. Sourav Ganguly became the President of BCCI on 23 October 2019. Prior to this, he became the Secretary of Cricket Association of Bengal in 2014, then in 2015 he got the post of President.
Similarly, Jay Shah became the Joint Secretary of Gujarat Cricket Association in 2014. It is said that his term had started from September 8, 2013. That is, from September 2013 to October 2019, he was associated with the Gujarat Cricket Association. After this, he took over the post of BCCI Secretary on 24 October 2019. It is being said that both will remain in their posts for the next three years.
