Allahabad High Court directed to make Police Inspector Deputy SP, order of ACS Home canceled

The Allahabad High Court has directed the Inspector posted in the Civil Police to be made Deputy SP. The court has set aside the order of the Additional Chief Secretary Home, by which the promotion of Inspector was not made Deputy SP by putting it in a sealed cover.

Justice Neeraj Tiwari has given this order while allowing the petition of Inspector Uday Pratap Singh. The petitioner Inspector is presently posted at Fatehgarh / Farrukhabad. The order passed on 12 August 2021 of ACS Home was challenged by filing a petition. It was demanded that by canceling this order, the petitioner Inspector should be made Deputy SP in accordance with the orders of 28 May 1997 and 9 January 2018 and his sealed cover should be opened. The promotion of the Inspector was denied on the basis of charge sheet filed in a 302 case registered during his posting in Jaunpur. Chargesheet was filed against the petitioner under sections 217, 218, 20, and 120B of the Indian Penal Code.

Senior advocate Vijay Gautam, appearing for the petitioner inspector, argued that the further action of the criminal case on the basis of the charge sheet is stayed by the Allahabad High Court. It was argued that despite the pendency of the case, the petitioner was given out of turn promotion and made Inspector from Inspector in the year 2006. The service record of the petitioner is impeccable and no departmental proceedings have ever been taken against him.

Even in an earlier petition filed by the petitioner, the Additional Director of Police, while sending his remarks to the Secretary Home, has said that the record of the petitioner is spotless and there is no punishment against him. Her character is very clean and beautiful and for the last 17 years she has not misused her position.

The court, after hearing the petitioner’s advocate and public prosecutor, based on the decision given by the High Court in the case of Neeraj Kumar Pandey, directed that the order of ACS Home is set aside on August 12, 2021. The court has also directed the petitioner to be promoted to the post of Deputy SP with all consequential benefits.
