Uttarakhand : Preparation to give reservation to the agitators again, the file of reservation sent to the legal opinion

In Uttarakhand, the work of finding ways to give horizontal reservation to the state agitators has started. The government has extended the file to seek legal opinion from the Justice Department. However, legal experts say that now the government is left with the only option of bringing an ordinance to give reservation to the agitators immediately.
High Court has stayed
In August 2013, the High Court had banned 10 per cent horizontal reservation in government jobs for state agitators. Whereas in the year 2018, the mandate of reservation, circular and notification has been rejected all three. In the year 2015, the Harish Rawat government had passed a bill in the House to give the benefit of reservation. Since then it was lying pending in the Raj Bhavan. In September 2022, the Dhami government had sought it back for reconsideration. However, the government has claimed that by removing the flaws in the bill, they will again provide the agitators the benefit of horizontal reservation, but the situation is not clear on this yet.
ND Tiwari gave this benefit in jobs
In the year 2004, the ND Tiwari government was the first to give this benefit in jobs to the agitators. However, this facility was only for five years, but then it was extended. Under this, the agitators and their dependents who were in jail for more than seven days had the right to give direct jobs to the committee constituted under the chairmanship of the district magistrates. At the same time, the benefit of 10% horizontal reservation is being given to the identified agitators and dependents in government jobs. Sources said that the Personnel Department has submitted the entire report for the period 2004 to 2018 to the higher level. Along with this, again consultation has been sought from the Justice Department.
Right now only getting the benefit of pension
State agitators are getting the benefit of pension only. It has three categories. 20,000 to completely helpless agitators, seven days or more in jail and injured agitators 6000 while active agitators are getting pension of Rs 4500 per month at present.
Reservation will continue to be available in medical, nursing admissions
Women will continue to get the benefit of 30 percent horizontal reservation in admission to NEET-PG, UG and Nursing and Paramedical courses.
Legal opinion will be taken on the reinstatement of VIS personnel
The Vidhan Sabha Secretariat is taking legal opinion regarding the sacked employees reinstated after the order of the Nainital High Court.
Secretary, Personnel Department Shailesh Bagchi said that the government is considering options. In this sequence, advice has been sought from the Justice Department. What steps can be taken after recalling the ordinance from the Raj Bhavan, discussions are going on right now. A complete report has been prepared between getting the benefit of reservation and ending it after the order of the High Court.
Many did not get jobs even after selection
Despite selection in many departments, more than 16 agitators could not get joining. After the ban on reservation, the respective heads of departments stopped the appointment process. At the same time, the agitating Kranti Kukreti, Dan Singh, Jagdish Pant were fired after serving for a few months.
