Supreme Court will not reconsider the decision to cancel class 12th board exam

The Supreme Court said that the decision to cancel the Class 12 board examination will not be reversed and also approved the evaluation scheme of CISCE and CBSE based on the results of class 10th, 11th and 12th respectively at 30:30: The formula of 40 will be adopted.

The Council of Indian School Certificate Examinations (CISCE), however, said that it is considering the performance of the last six classes for evaluation of students while the Central Board of Secondary Education (CBSE) for preparing the final results of students of class 12, class 10, It is proposed to make the performance of class 11th and 12th the basis. Both the boards said that they will declare the results on or before July 31. The CBSE, while briefing the court about its evaluation system, said that 30 per cent marks in the evaluation of class 12 students on the basis of 10th class board examination, 30 per cent on the basis of 11th class marks and 40 per cent marks on the basis of class 12th half yearly. Will be given on the basis of exam or pre board exam.

CBSE said that the marks obtained in practical examination and internal assessment on actual basis, which have been uploaded on the portal of the school CBSE, will also be taken into consideration while preparing the final results. A Special Holiday Bench of Justices AM Khanwilkar and Dinesh Maheshwari also rejected the request of senior advocate Vikas Singh to reconsider the decision of CBSE and CISCE to cancel class 12 examinations. Singh’s argument was that the Common Method Entrance Test (CLAT) would be conducted in the traditional manner.

We have no doubt that the matter should not be taken forward, the bench said. We have already accepted the decision taken by the Board in principle and which was placed before us. Anyway, students who want to take the exam to improve marks can do so, this system takes care of such students. In other words, there will be no prejudice against the students who want to take the exam. During the hearing held through video conferencing, the top court said that there is no apprehension about accepting the prima facie evaluation plan and the board can go ahead with it. The bench told Attorney General KK Venugopal, appearing for CBSE and advocate JK Das, appearing for CISCE that, however, there should be a provision for dispute resolution in the (evaluation) scheme if the students want improvement in the final result and other results. The timetable for the declaration and the optional exam is released. Both the boards agreed to the suggestion of the bench and the matter has been adjourned till Monday, at which time senior advocate Vikas Singh will present his stand on the evaluation plan.

The bench said that we will hear the matter on Monday. You (CISCE and CBSE) are at liberty to finalize and notify your plan. If there is any suggestion, we can consider it. Simultaneously, the bench said that Singh’s suggestion may be incorporated later. The Supreme Court was hearing petitions seeking a direction to cancel the Class 12 examinations of the Central Board of Secondary Education (CBSE) and the Council for the Indian School Certificate Examinations (CISCE) amid the coronavirus pandemic situation.
Hearing some interim petitions filed by various states for cancellation of class 12 board exams, the bench said that the copy of the application should be given to the lawyers for the state governments.
