Uttarakhand / Dehradun : Mother and son imprisoned for seven years for culpable homicide

The court of Special Judge Poxo Meena Deopa has convicted the accused mother and son in a case of culpable homicide and sentenced both to seven years’ imprisonment and a fine of Rs 10,000 each. In default of payment of fine, both will have to undergo additional imprisonment of three months each.

Assistant District Government Advocate Bharat Singh Negi told that the complainant Kamala Devi had given a complaint in Dalanwala Kotwali that she used to live on rent at Sahib Singh’s house. Sita Devi and her son Rajesh Kumar lived in another room. On May 28, there was a dispute between them regarding some issue. Sita Devi and her Rajesh Kumar beat up Kamala Devi and her son Sagar Tiwari badly. Sita Devi and her son attacked Sagar Tiwari’s private parts with the remote of the TV, due to which he was badly injured. He was admitted to a private hospital for treatment, where Sagar Tiwari died during treatment on 23 June 2017. Sagar Tiwari was the only son of Kamala Devi. In this case, a case was registered on May 29 under sections of assault, but after the death of injured Sagar Tiwari, the section of culpable homicide against mother and son was increased.

Assistant District Government Advocate told that in this case, Kamala Devi’s landlord Sahib Singh, his wife and daughter became eyewitnesses. In the medical report also, the reason for Sagar Tiwari’s death was also injury on the genitals. He told that the accused Rajesh Kumar was a minor at the time of the incident, so the matter came to the POCSO Court.
