PM Narendra Modi wore military uniform and filed for trial in Prayagraj, court sent notice to PMO

The District Court has ordered to issue notice to the Prime Minister’s Office (PMO) on the monitoring petition filed against Prime Minister Narendra Modi. The matter will now come up for hearing on March 2. District Judge Nalin Kumar Srivastava passed this order after hearing the arguments on the surveillance petition presented by advocate Rakesh Nath Pandey.

In fact, against Prime Minister Narendra Modi, Rakesh Nath Pandey had submitted an application under Section 156 (3) of the Code of Criminal Procedure and requested for an order to be filed. In the application filed, it was alleged that on November 4, 2021, in Nowshera, Jammu and Kashmir, the Prime Minister wore the uniform of the Indian Army, which is an offense punishable under Section 140 of the Indian Penal Code, so a case should be written against the PM.

Chief Judicial Magistrate Harendra Nath heard the application on 21 December 2021. Then in the case, the court said that the incident did not happen under the jurisdiction of the court. The matter can be heard by the same Magistrate who has local jurisdiction. CJM on the basis of Sustainability. Harendra Nath rejected the application. This order was challenged by presenting a monitoring petition before the District Judge and demanded that the order be quashed. After hearing the monitoring petition, the District Judge ordered the issue of notice.
