Supreme Court refuses to stop bulldozer action, judge said – ‘This will reduce the power of municipal corporations’

Hearing in the Uttar Pradesh bulldozer case was held in the Supreme Court. The Supreme Court has refused to grant an interim stay on the bulldozer proceedings for sabotage in the states. The court said that they cannot issue an order of general prohibition in the process of demolition of illegal constructions. Due to this, the rights of local bodies i.e. municipal bodies will be curtailed. Now the next hearing in this matter will be held on August 10. Notices have also been issued to Gujarat and Madhya Pradesh. Senior advocate Harish Salve has appeared on behalf of the Kanpur / Prayagraj administration. SG Tushar Mehta on behalf of UP Govt.

The lawyer appearing for the petitioner of the claim said that according to the report of the news paper – the house of the accused of murder was demolished in Assam. This should stop, a detailed hearing is needed in this matter. SG Mehta started the debate. Demolition has taken place in some places, but according to the rules – legal proceedings had started before the violence. This topic should not be sensationalised. SC said whether hearing in this matter should be done on August 8?

During the hearing, Dave alleged that pick and choose policy is being adopted, a community is being targeted. SG objected and said all belong to Indian community. You can’t argue like this. Dave said that you see that almost all the farm houses in Delhi are illegal, but no action is being taken on that. Dave said that you should order a stay, the court said that how can you give such an order?

SC said that it will hear the matter on August 10. All the parties can file their reply till August 8. The court has also issued notices to the Madhya Pradesh and Gujarat governments.

Justice BR Gavai said that there cannot be an absolute ban on taking action by the municipal authorities. It should be investigated on a case by case basis. CU Singh said that Jamiat filed the petition because this issue is happening all over the country. Dave said that you see almost all the farm houses in Delhi are illegal, but no action is being taken on that.

Dave said that you should order a stay, on which the court said that how can you give such an order? This is not good for the society.

CU Singh- Jamiat filed the petition, because this issue is happening all over the country.

Salve said that it cannot happen that if there is an accused, then his house cannot be demolished according to the rules of the corporation. Action is being taken as per the rules.
