‘Judge sir, I am alive…’ Why did the boy have to give proof of his being alive in the Supreme Court?

A special leave petition was heard in the Supreme Court last week. A surprising incident came to light during the hearing. When an 11 year old boy appeared before the court and said that he is alive. The case is related to the murder of a boy. The boy claimed in the court that his father falsely implicated his maternal grandfather and maternal uncles in the case of his murder.
Accepting the petition, the court said that no action will be taken against the petitioners till further orders. Along with this, the court has issued notice to UP government, Pilibhit SP and SHO of Newriya Police. According to TOI, petitioner’s lawyer Kuldeep Johri said that the boy has been living with his maternal grandfather since February 2013. According to the information, her father used to beat her mother mercilessly for dowry. According to the lawyer, both of them were married in 2010. In March 2013, the boy’s mother suffered serious injuries due to the beating, after which she died during treatment in the hospital.

The maternal grandfather of the boy who died filed a case against his son-in-law under section 340B of the IPC. Meanwhile, the father asked for the custody of the boy. On which both the parties filed a case against each other. The lawyer said that the boy’s father filed a case against his maternal grandfather and maternal uncles in January this year, accusing them of murdering the boy. Police registered a case under sections 302, 504 and 506 of IPC in this matter.
Regarding the matter, the lawyer said that he approached the Allahabad High Court with the FIR, but the court rejected his petition. After which the boy had to appear in the Supreme Court as proof of his being alive. The case will be heard in January next year.
