Supreme Court banned bulldozer action across the country, action allowed only in these cases
The Supreme Court has given a big order on Tuesday and has banned bulldozer action across the country. This direction has been given in the Supreme Court hearing on the petition filed by Jamiat Ulema-e-Hind against the bulldozer action in Uttar Pradesh and other states. The bench of Justice BR Gavai and Justice KV Vishwanathan has given this direction.
Permission to take action in these cases
The Supreme Court has said that demolition will be banned across the country till further orders. However, this order will not apply to illegal encroachments on public roads, streets, water bodies, footpaths, railway lines etc. The Supreme Court said that glorification and show of bulldozer justice cannot be allowed in the country.
What was the argument given in the court
During the hearing, SG Tushar Mehta said that wherever the demolition action has taken place, it has been done by following the legal process. The allegation of targeting a particular community is wrong. Wrong narrative is being spread. On this, Justice Vishwanathan said that the things happening outside the court do not affect us. We will not go into the debate whether a particular community is being targeted or not. If there is even one issue of illegal demolition, then it is against the spirit of the Constitution.
We are not being influenced by the narrative – Supreme Court
At the same time, Justice Gavai said in the hearing that we are not being influenced by the narrative. We have made it clear that we are not in favor of protecting illegal construction. But we cannot become executive judges. There is a need to streamline the demolition process. After this, Justice BR Gavai got it written in the order that there will be freedom to demolish illegal constructions done on roads, streets, footpaths or public places with proper procedure.
