‘Supreme’ stay on High Court order in Uttarakhand High Court shifting case, government was ordered to choose the location within a month

These days, there is a lot of commotion in Uttarakhand regarding the shifting of Nainital High Court. Voting is being conducted for this by the Nainital High Court. The matter was heard in the Supreme Court today. While hearing the matter, the Supreme Court’s vacation bench comprising Justice PS Narasimha and Justice Sanjay Karol has stayed the High Court’s order and issued notice to the opponents. The Supreme Court has also sought a reply from the state government. Today, the SLP of the High Court Bar Association was argued by senior Supreme Court advocate PVS Suresh. High Court Bar Association President DCS Rawat has confirmed this. This matter is now listed after the holidays i.e. after July 8.
The Dehradun Bar Association had also filed a caveat to present its side. After hearing all the parties, the Supreme Court has stayed the High Court’s order. On behalf of the High Court Bar Association, senior Supreme Court advocates PB Suresh, Vipin Nair, B Vinod Kanna, Advocate on Record, Dr. Kartikeya Hari Gupta, Pallavi Bahuguna, High Court Bar Association President DCS Rawat, Secretary Saurabh Adhikari, Bidhi Pandey, Kartik Jaishankar, Rafat Muntazir Ali, Irum Jeba, Vikas Guglani, Yogesh Pacholia, Shagufa Khan, Dr. CS Joshi and Meenakshi Joshi presented their side. On the other hand, senior advocates Siddharth Luthra and Supriya Juneja presented their side on behalf of the Dehradun Bar Association. The Dehradun Bar Association said that there is less space for the expansion of the High Court in Nainital. 70 percent of the cases in the High Court are from the Garhwal Division. Sufficient facilities are not available for litigants and advocates. Therefore, it should be shifted.
What was the High Court’s order
Earlier on May 8, a division bench of Uttarakhand High Court Chief Justice Ritu Bahri and Justice Rakesh Thapliyal passed an order stating that it was necessary to shift the High Court from Nainital to some other place and directed the government to select a place for the High Court within a month.
