The CBI will challenge Kuldeep Sengar’s bail in the Unnao case and has decided to approach the Supreme Court

Sengar to remain in jail in the second case
The CBI and the victim’s family had cited security threats and intimidation and opposed Sengar’s bail. They said they would challenge this order as soon as possible. A CBI spokesperson said in a statement that it has been decided to file a Special Leave Petition (SLP) in the Supreme Court as soon as possible against the High Court order suspending Sengar’s life sentence and granting him bail. However, Sengar will remain in jail as he is also serving a 10-year sentence in the case of the custodial death of the rape victim’s father.

Opposition to Sengar’s plea
Sengar had filed an appeal against his life sentence, which was strongly opposed by the CBI and the victim’s family in the High Court. The statement said, “The CBI had filed a timely reply and written submissions in this case. The victim’s family has also opposed the petition, citing security concerns and threats. The CBI will challenge this order immediately.”

The Delhi High Court on Tuesday suspended the jail sentence of expelled BJP leader Sengar, who was serving a life sentence in the 2017 Unnao rape case. The court said that he has already spent seven years and five months in jail. The High Court suspended Sengar’s sentence pending his appeal challenging the conviction and sentence in the rape case. Sengar challenged the lower court’s judgment delivered in December 2019 in this case. Imposing several conditions for bail, a bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar directed Sengar to furnish a personal bond of Rs 15 lakh and three sureties of the same amount.
