Supreme Court refuses to hear plea for CBI probe and commission for lack of oxygen
The Supreme Court has refused to hear the petition for the formation of a judicial commission to conduct a CBI inquiry into the lack of oxygen in the country and to make arrangements for distribution. The Supreme Court said- If you want an investigation, then you had to give a complaint to the police. We have formed a national task force for oxygen. We will not give any order to demoralize doctors and officers.
A bench of Justice DY Chadrachud and Justice BV Nagarathna said that with the developed infrastructure in terms of health, the most developed countries of the world are also struggling to deal with the epidemic. It is very easy to criticize the government and the court without being in the hot seat. At this point of time, should we do such a legal postmortem or do we do something positive that we have done in setting up the task force.
The Court observed that the allegation with respect to the routes of criminal error cannot be treated without sufficient material and cannot be leveled lightly. A National Task Force has been constituted and the court cannot encroach upon the domain of the executive.
