In the National Herald case, former Congress President and MP from Wayanad, Kerala, Rahul Gandhi has been questioned for nearly 30 hours for three consecutive days. Now once again on behalf of the central agency ED has been called for questioning on Friday. Here, on the other hand, the country’s oldest party is very angry against it and the workers are on the streets. The Congress alleges that the Delhi Police is working at the behest of the Center to suppress their Satyagraha.
On Rahul’s interrogation, Rajasthan CM Ashok Gehlot attacked the central government and said that ED will do its work, Rahul Gandhi is respecting the law, is cooperating. But in Delhi, the police have created panic. Who is the police to stop you from coming to the party office? In this matter, Congress leaders can complain to Home Minister Amit Shah and President Ram Nath Kovind.
Congress will gherao Raj Bhavans
Congress leaders have alleged that on Wednesday, police and paramilitary forces entered the Congress party headquarters and misbehaved with the leaders and journalists present. Congress has decided to gherao Raj Bhavans across the country in protest against the police action. In Delhi, party workers under the leadership of state president Anil Chaudhary will gherao the Raj Bhavan at 11.30 am. UP Congress workers will gherao the Raj Bhavan at 11 am. The gherao of Raj Bhavan will start in Bhopal at 11 am under the leadership of Kamal Nath. Raj Bhavan will be gheraoed in Jaipur at 10 am under the leadership of Rajasthan Congress President Govind Singh Dotasara. Under the leadership of State Congress President Ghulam Ahmed Mir, there will be a gherao of the Raj Bhavan in Jammu at 10.30 am.
ED officials say that during the three-day interrogation, audio and video recording of Rahul Gandhi’s statement was done. Their statements are being typed on A4 size paper and shown and signed on minute to minute basis and then handed over to the investigating officer.
Question being raised on properties worth 800 crores
News agency PTI, citing sources in the probe agency, said that Rahul Gandhi is being questioned about properties worth around Rs 800 crore owned by AJL and also how a non-profit company The ‘Young Indian’ was carrying out the commercial activities of letting out its land and buildings. Congress claims that there is no FIR in this case and not a ‘scheduled offence’ on the basis of which a case of Prevention of Money Laundering Act (PMLA) should be registered and Rahul Gandhi and Sonia Gandhi should be summoned.
Officials said the ED’s proceedings were much more concrete than the proceedings based on FIRs as the court took cognizance of the charge sheet filed by the Income Tax Department and continued the process. He says that sections 120B (criminal conspiracy) and 420 (cheating) of the Indian Penal Code are applicable in the case of income tax and they determine the offenses for which the ED can file a case of money laundering.
ED Investigating Officers also say that money laundering is defined under Section 3 of PMLA and ED is applying it to probe the role of Rahul Gandhi in this entire case, “while there is no cash exchange in it”. But the offense has been profited and some persons have benefited.’ According to section 3 of PMLA, ‘Whoever attempts to engage directly or indirectly in any proceeding or activity connected with the process of the offence, or Willfully aids or willfully becomes a party or is actually involved and is presenting the same as immaculate property, he shall also be guilty of the offense of money laundering.’
The officials contested the Congress’ claim that ‘Young Indian’ is a non-profit company in which no one can take profit. Officials said violation of the law is an offense and the Income Tax Department’s charge sheet and the Enforcement Case Information Report (ECIR) in this case indicate that the provisions of the non-profit company have been violated.
Pawan Bansal and Kharge have been interrogated
PTI quoted sources as saying that the question has been raised about the things of ‘Young Indian’ since its inception in 2011. In this case, the ED has earlier questioned two senior Congress leaders Pawan Kumar Bansal and Mallikarjun Kharge. In the same case, the ED has asked Congress President Sonia Gandhi to appear on June 23. Sonia Gandhi is unwell due to corona virus infection and is currently admitted to Sir Ganga Ram Hospital.
According to officials, the questioning of senior Congress leaders and the Gandhi family is part of the ED’s probe to understand the stake pattern, financial transactions and role of promoters of ‘Young Indian’ and ‘Associated Journals Limited’ (AJL). . The promoters and shareholders of ‘Young Indian’ include Sonia Gandhi and some other Congress leaders including Rahul Gandhi. The Congress says that the allegations leveled against its top leaders are baseless and the ED’s action is being taken under the politics of vendetta.
