‘Government not responsible for death due to corona vaccine’, affidavit of Center in SC

The central government has refused to take any responsibility on the alleged deaths due to corona vaccination. The Center said in an affidavit filed in the Supreme Court that it has full sympathy for the deceased and their families, but cannot be held responsible for any adverse effects after vaccination.

Actually, this case is related to the death of two girls last year allegedly after corona vaccination. In this case, the parents of the girls approached the Supreme Court. In the petition, the Supreme Court was demanded to conduct an independent inquiry into these alleged deaths due to corona vaccination. In the petition, there has also been a demand to order the formation of a board of experts to detect any side effects after vaccination in time and take measures to prevent them.

Center filed reply

On this petition, the Supreme Court issued a notice and sought an answer from the Center. The Union Ministry of Health and Family Welfare filed an affidavit on this. It has been said that it would not be legally appropriate to hold the Center responsible for the deaths and compensation due to adverse effects of vaccines.

Expressing condolences and consolation on the death of both the girls, the court said that in only one case the AEFI committee has confirmed the death due to side effects of vaccination. In the reply filed through an affidavit, the central government said that in cases where death has occurred due to the vaccine, compensation can be sought by filing a case in the civil court.

Rejecting the demand for compensation of the petitioner, the Ministry of Health has said that if a person suffers physical injury or dies due to the side effects of vaccination, then according to the law, he or his family can claim compensation or damages. Can claim in civil court. It has been said in the affidavit that such cases regarding negligence can be filed on a case-by-case basis.
