Supreme Court said- water above the head, do not force us to summon the officers

The Supreme Court has expressed strong displeasure over the tendency of the UP government to comply with court orders only after the contempt petition is filed. The top court said that now the water has come above the head. Do not force us to summon officers.

A bench of Chief Justice (CJI) Justice DY Chandrachud and Justice PS Narasimha made the remarks while hearing contempt petitions filed for non-compliance of orders relating to premature release of prisoners who have been in jail for decades. The bench observed that the application of a convict was considered after the contempt case was filed.

The CJI told Additional Advocate General (AAG) Garima Prasad, appearing for the UP government, that we have seen that the government acts after contempt petitions are filed, it is unfair. We do not want the officials to be called to court as they have other work to do. But now enough is enough. Will not make concessions now. We should not be compelled to present the officers in person.

The CJI told the AAG, you (the state) put your ‘house’ in order. If this does not happen, we will summon the Director General. During the hearing, the AAG told the bench that the application has been considered.
